New guidelines for enforcing Advertisement Regulation are announced. Basically, this is to clarify the procedures for various related departments. The guidelines are said to be a trial version. It depends on the outcome whether changes are required.

Revised "Foreign Involved Investigation Regulation" 13.10.2004

Just a week ago, there is a revised regulation about “Foreign Involved Investigation Regulation” is announced, replacing the previous regulation and is effective from Oct. 13, 2004.

This regulation states clearly what is the nature covered, including working by Chinese establishment for foreign interest, assignment from foreign interest, joint operation and any similar activities that generating reports about personal, marketing research, social research to foreign interest.

Forbidden investigation is nothing unusual. Those concern anything against the constitution, harmful to unification, cult and those producing instabilities or against the law and regulation.

Application for such type of investigation is required and documents are clearly listed.

Revised "Bill of Exchange Law" 28.08.2004

Announced and effected on Aug. 28, 2004
The original Clause No.75 "The management and authorization for issuing bank order is to be regulated by Bank of China." is deleted.

After deletion, the total number of clauses of this law is changed from 111 to 110.

New "Digital Signature Law" 28.08.2004

Announce date: Aug. 28, 2004
Effective date: Apr. 1, 2005

This law is for legalization the use of digital signature and to protect the legal benefit of parties concerned.

Digital signature is not applicable for marriage, adoption etc. that related to personal relationship, not for fixtures like land, house, not for public facilities like water, heat, gas, electric supply, and not for those cases stated by legal bodies or government administration.

There are clauses to regulate the general standard of digital signature including the format, the authentication etc. The requirements for Authentication bodies are clearly stated, including the application procedure as well as the proper way to record and to withdraw.

With mutual agreement and validity, foreign digital signature will have the same legal effect.
